Ask the Attorney: Divorce bankruptcy

Ask the Attorney

My wife moved out about a year ago and I am now going to start the divorce.
There is no equity in the marital home. We have two minor children.
We have about $40,000 in credit card debt from the marriage though it is all in my name.
I cannot afford to pay it and keep supporting my kids and paying the mortgage on the house.
Should I file for bankruptcy now, or wait until after the divorce?
