Man wrongfully accused of murder released, Miami criminal defense lawyer questions single-witness cases

Last week, it was revealed that 20-year-old Walter Collier, who was arrested and charged with second-degree murder earlier this year, had been released. In February, a man was shot in the parking lot of a local grocery store. Collier was arrested for the crime after another local resident, claiming to be an eyewitness, told police he’d seen the man approach the victim – Emanuel McGhee – and threaten him. The witness said he saw Collier pull out a gun and that he heard the single shot that killed McGhee as the suspect fled the scene.

Though there were no additional witnesses to back up the accusation, Collier was eventually charged and imprisoned for the murder of McGhee. It wasn’t until 17-year-old Marquise Bess confessed to the crime at the end of last month that law officials realized they had the wrong man. After 37 days in jail, Collier was released.

The head of Miami’s homicide unit, Miami Cmdr. Eunice Cooper, told The Miami Herald that aspects of eyewitness testimony did match up with other accounts of the crime, but no one else had named the shooter. Collier’s Miami criminal defense lawyer also spoke to the news outlet after his client’s release.

“Police really need to investigate the motives of witnesses, especially in a one-witness case, before any kind of an arrest is made based on that person’s word,” the Miami criminal defense attorney said.
